These Terms of Service (“Terms”) govern your access to and use of Family Caddy, a product of EightFive Technology (“we”, “us”, or “our”), including our website and applications (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Eligibility
You must be at least 18 years old and able to enter into a binding agreement to create an account. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
The Service
Family Caddy is an all-in-one family organizer that brings together your calendar, chores, goals, star rewards, and lists in one place. We may add, change, or remove features over time to improve the Service.
Your account
You are responsible for the activity that happens under your account and for keeping your sign-in method secure. Family Caddy uses a trusted identity provider for authentication; you are responsible for maintaining the security of the account you use to sign in. The adult account owner is responsible for the household information they add and for the family members they manage within the Service. Please notify us promptly of any unauthorized use of your account.
Subscriptions, billing, and cancellations
- Family Caddy may offer free and paid plans. Paid subscriptions are billed through our payment provider, Stripe, according to the price and billing cycle shown at checkout.
- Unless stated otherwise, subscriptions renew automatically at the end of each billing period until you cancel.
- You can cancel at any time; cancellation takes effect at the end of the current billing period, and you will retain access until then.
- Except where required by law, payments are non-refundable. Taxes may apply depending on your location.
- We may change our prices. If we do, we will give you reasonable notice before the change applies to your subscription.
Acceptable use
When using the Service, you agree not to:
- Break the law or infringe the rights of others.
- Attempt to access accounts or data that are not yours.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
- Reverse engineer, resell, or misuse the Service except as permitted by law.
- Upload malicious code or content that is unlawful, harmful, or abusive.
Your content
You retain ownership of the information and content you add to Family Caddy (“Your Content”). You grant us a limited licence to host, store, process, and display Your Content solely to operate and improve the Service for you and your family. You are responsible for Your Content and for having the rights to add it.
Third-party services
The Service integrates with third parties such as Google (calendar), Microsoft (identity and hosting), and Stripe (payments). Your use of those integrations may be subject to the third party’s own terms and privacy policies. We are not responsible for third-party services, and connecting them is at your discretion.
Intellectual property
The Service, including its software, design, branding, and content (excluding Your Content), is owned by EightFive Technology and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding without our prior written permission.
Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Family Caddy is a household organization tool and should not be relied upon for emergencies or time-critical matters.
Limitation of liability
To the maximum extent permitted by law, EightFive Technology will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $50.
Indemnification
You agree to indemnify and hold harmless EightFive Technology from any claims, losses, or expenses arising out of your misuse of the Service, Your Content, or your violation of these Terms or applicable law.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Provisions that by their nature should survive termination will continue to apply.
Changes to the Service and these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws applicable at the place of establishment of EightFive Technology, without regard to conflict-of-law principles. Any disputes will be handled by the competent courts of that jurisdiction, unless otherwise required by mandatory local law that applies to you.
